This website is operated by Norden Floors LLC, doing business as Norden Floors (“Norden Floors,” “Norden,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of the Norden Floors website, online store, products, services, samples, customer accounts, communications, and purchases.
By accessing our website, creating an account, requesting or purchasing samples, placing an order, purchasing products, or otherwise using our services (collectively, the “Service”), you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, Refund, Return & Damage Policy, applicable product warranties, installation instructions, care and maintenance instructions, and any other policies referenced on our website.
If you do not agree to these Terms, you may not use the Service or purchase products from Norden Floors.
Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which certain products and services are offered.
Nothing in these Terms limits any rights or remedies that cannot legally be limited, excluded, or waived under applicable law.
Eligibility and Online Store Terms
By using the Service, you represent that you are at least the age of majority in your state or jurisdiction of residence and have the legal capacity to enter into a binding agreement.
You may not use our website, products, or services for any illegal, fraudulent, unauthorized, or prohibited purpose, nor may you violate applicable laws or regulations in connection with your use of the Service.

Products and Natural Material Characteristics
Norden Floors sells products including engineered hardwood flooring, wood flooring, flooring accessories, samples, moldings, and related materials.
Wood is a natural material. Variations in color, tone, grain, knots, mineral streaking, character, texture, pattern, shade, board length, surface appearance, and other natural characteristics are expected and are not necessarily defects.
These characteristics may vary:

Between production runs or batches

Between samples and full flooring orders

Between photographs and physical products

Over time due to light exposure, oxidation, aging, environmental conditions, and normal use
Natural variation is part of the appearance and character of real wood flooring.
Unless expressly stated otherwise in an applicable written warranty, variations inherent to natural wood or falling within the product's stated grade, specification, or reasonable manufacturing tolerance do not constitute a product defect.
Samples, Photography, and Color Representation
Norden Floors makes reasonable efforts to display and describe our products accurately.
However, photographs, videos, digital renderings, website images, room scenes, samples, and display devices cannot perfectly represent every board or completed installation.
Color, texture, tone, grain, and appearance may differ because of photography, lighting, screen settings, manufacturing variation, natural wood variation, finishing processes, and differences between production batches.
Samples are intended to help customers evaluate the general appearance, construction, finish, texture, and character of a product. Because wood is a natural material, a sample represents only a small portion of the product and does not guarantee that every board or carton in a full flooring order will match the sample exactly.
Customers are responsible for evaluating samples, product specifications, and available product information before ordering when appearance, color, grade, texture, or other characteristics are material to their purchasing decision.
Product Information and Specifications
We make reasonable efforts to provide accurate product descriptions, specifications, dimensions, coverage quantities, construction details, photographs, technical information, availability, pricing, and other information.
Certain dimensions, measurements, weights, coverage figures, colors, and similar descriptions may be approximate or subject to normal manufacturing tolerances.
We reserve the right to correct errors, inaccuracies, or omissions and to modify product information, specifications, or descriptions at any time.
Customers, contractors, designers, architects, and installers are responsible for reviewing applicable product specifications and determining whether the selected product is appropriate for the intended project, location, installation method, and environmental conditions before ordering and installation.
Project Measurements and Ordering Quantities
Customers are responsible for determining the amount of flooring and related materials required for their projects.
Any flooring calculator, square-footage calculator, quantity recommendation, estimate, customer-service recommendation, or similar tool provided by Norden Floors is provided for convenience only and does not replace measurements or calculations performed by a qualified installer, contractor, architect, designer, or other appropriate professional.

Customers should order an appropriate amount of additional material for waste, cutting, board selection, and future repairs based on the requirements of their particular project.
Norden Floors is not responsible for shortages resulting from inaccurate measurements, inadequate overage, installer calculations, project changes, or customer ordering decisions.
Carton Quantities and Square-Foot Pricing
Certain flooring products may be displayed or priced by square foot while being sold and fulfilled only in complete cartons.
Where applicable, the number of cartons required may be calculated by rounding the requested project quantity upward to the nearest complete carton.
The final amount charged will be based on the actual quantity contained in the complete cartons purchased, rather than solely on the customer's initially entered square footage.
Coverage per carton varies by product and is identified on the applicable product page or order documentation.
Partial cartons may not be available unless expressly stated otherwise.
Customers are responsible for reviewing the final carton quantity, total square footage, and order total before completing their purchase.
Pricing
All prices are stated in U.S. dollars unless otherwise specified.
Prices, promotions, discounts, product availability, shipping charges, and product specifications may change without notice before an order is accepted.
Placing a product in your shopping cart does not reserve its price, inventory, or availability.
Prices displayed for flooring may be represented on a per-square-foot basis even where the product is sold by full carton. Where applicable, the final order total will reflect the number of complete cartons required.
Taxes, shipping, freight, duties, handling charges, accessorial charges, and other applicable fees may be added separately unless expressly stated as included.
Pricing, Website Errors, and Inaccuracies
Occasionally, information on our website or Service may contain typographical errors, incorrect prices, inaccurate specifications, incorrect measurements, incorrect shipping calculations, inventory errors, or other inaccuracies or omissions.
We reserve the right, to the extent permitted by applicable law, to correct errors, inaccuracies, or omissions and to update information or cancel affected orders.
If an order has been charged at a materially incorrect price and Norden Floors elects not to fulfill the order at that price, we will notify the customer and refund amounts paid for the canceled product as appropriate.
Norden Floors is not obligated to fulfill an order resulting from an obvious pricing, quantity, promotional, technical, or shipping-calculation error.
Orders and Order Acceptance
Submitting an order constitutes an offer to purchase products from Norden Floors.
An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance of the order.
We reserve the right, subject to applicable law, to accept, reject, place on hold, limit, or cancel an order for reasons including:

If we cancel all or part of an order after payment has been collected, we will refund the applicable amount in accordance with these Terms and applicable law.
Order Changes and Cancellations
If you need to cancel or modify an order, you must contact Norden Floors as soon as possible.
Orders may generally be canceled or modified only before they have entered processing, fulfillment, production, warehouse preparation, or freight scheduling.
Once an order has entered any of these stages, modification or cancellation is not guaranteed and may no longer be possible.
Orders that have shipped cannot be canceled and must follow the applicable return process.
Custom products, special orders, made-to-order items, custom moldings, products specifically sourced or produced for a customer, and other designated final-sale items may not be modified, canceled, or returned once confirmed.
Additional terms governing cancellations and returns are contained in our Refund, Return & Damage Policy, which is incorporated into these Terms by reference.
Payment
Payment is due according to the terms presented during checkout, on the applicable invoice, quotation, purchase order, or other written agreement issued by Norden Floors.
You represent and warrant that you are authorized to use the payment method submitted for your purchase.
You agree to provide current, complete, and accurate billing, shipping, account, and payment information and to promptly update such information where necessary.
You are responsible for applicable taxes, duties, fees, assessments, and other charges associated with your purchase unless otherwise expressly stated.
We may use third-party payment processors to process transactions.
Fraud Prevention and Order Verification
To protect customers and Norden Floors from fraudulent or unauthorized transactions, we may request additional information or verification before processing or shipping an order.
We may delay, decline, or cancel transactions that we reasonably believe may be unauthorized, fraudulent, abusive, or otherwise inconsistent with these Terms.
Customers are responsible for ensuring that billing and shipping information is accurate and that they are authorized to use the payment method submitted.
Shipping and Freight Delivery
Flooring orders may be shipped using parcel carriers, less-than-truckload (“LTL”) freight carriers, common carriers, or other transportation providers.
Many flooring orders are heavy, palletized freight shipments.
Unless expressly stated otherwise, freight delivery is generally scheduled curbside delivery and does not include:

Installation

Unpacking
-
Moving products into a residence, garage, building, or jobsite

Removal of packaging or pallets

Placement of flooring in a particular room

Forklift service

Pallet-jack service

Liftgate service unless included or specifically arranged

Jobsite material handling
Customers are responsible for ensuring that the delivery location can reasonably accommodate the applicable delivery vehicle and for arranging any labor, forklift, pallet jack, loading dock, equipment, or assistance necessary to receive and move the shipment.
Additional charges resulting from inaccessible delivery locations, missed appointments, redelivery, storage, reconsignment, address changes, limited-access locations, special delivery requirements, or other circumstances attributable to the customer or recipient may be the customer's responsibility to the extent permitted by law.
Our Shipping Policy is incorporated into these Terms by reference.
Delivery Dates and Delays
Processing times, fulfillment dates, freight-terminal arrival dates, transit times, and estimated delivery dates are estimates unless Norden Floors expressly guarantees a particular delivery date in writing.
Arrival of a shipment at a local freight terminal does not necessarily mean that delivery to the customer will occur on the same day.
Freight delivery may require a separate delivery appointment coordinated between the carrier and the recipient.
Norden Floors is not responsible for reasonable delays caused by carriers, severe weather, transportation disruptions, labor shortages, supply-chain conditions, port congestion, customs, manufacturing delays, natural disasters, governmental actions, or other circumstances beyond our reasonable control.
Customers should not schedule installers, contractors, or other project-dependent services until all required flooring has been delivered, inspected, and confirmed to be acceptable.
Customer Responsibility at Delivery
The customer, recipient, contractor, installer, or authorized representative accepting delivery should inspect the shipment before signing the carrier's delivery receipt whenever reasonably possible.
Before accepting the shipment, the recipient should inspect the pallet, cartons, wrapping, and visible product condition for signs of:

Punctures

Water exposure

Broken pallets
-
Torn wrapping
-
Missing cartons
-
Open cartons

Visible product damage

Other freight damage
Any visible shortage or damage should be clearly documented on the carrier's delivery receipt before it is signed.
Customers should photograph the shipment while it remains palletized and photograph any visible damage.
Signing a delivery receipt without notation of visible damage may affect our ability to establish that the damage occurred during transportation and may affect the handling of a freight claim.
Freight Damage and Concealed Damage
Visible freight damage must be documented with the carrier at delivery whenever reasonably possible and reported promptly to Norden Floors in accordance with our Refund, Return & Damage Policy.
Customers should retain all relevant materials, including:

Delivery receipts

Freight documentation
Concealed damage discovered after delivery must also be reported within the time period stated in our Refund, Return & Damage Policy.
Failure to preserve relevant evidence or to provide reasonable documentation within the applicable claim period may affect our ability to investigate or resolve a freight claim.
Nothing in this section limits rights that cannot legally be waived.
Inspection Before Installation
All flooring must be carefully inspected before installation.
The customer and installer are responsible for confirming, before installation:

Correct dimensions

Correct quantity

Acceptable milling

Acceptable finish

Acceptable appearance

Acceptable natural variation

Absence of reasonably visible defects
Do not install any board that is known or reasonably believed to be defective, damaged, incorrect, or otherwise unacceptable.
Questions or concerns regarding the product must be reported to Norden Floors before the affected flooring is installed.
Installation of a board constitutes acceptance of its reasonably observable appearance, color, grade, milling, finish, and visible condition, except where otherwise provided under an applicable written warranty or required by law.
Claims involving conditions that should reasonably have been identified before installation may be limited or excluded under the applicable warranty or claims policy to the extent permitted by law.
Storage and Acclimation
Flooring must be transported, stored, conditioned, acclimated where applicable, and installed in accordance with applicable product instructions and accepted installation practices.
The customer and installer are responsible for maintaining appropriate jobsite conditions before, during, and after installation.
This includes evaluating and managing, where applicable:

Relative humidity

Flooring moisture content

Subfloor moisture

Subfloor flatness
-
Structural suitability
-
Concrete conditions
-
Crawlspace conditions

HVAC operation

Water intrusion

Environmental stability
Failure to follow applicable storage, acclimation, moisture-testing, site-preparation, installation, or maintenance requirements may affect product performance and applicable warranty coverage.
Installation
Unless expressly agreed otherwise in writing, Norden Floors sells flooring materials and is not the installer.
The customer is responsible for selecting a qualified installer and determining whether the flooring is appropriate for the specific site, environment, subfloor, installation method, and intended use.
Installers and contractors are independent parties and are not agents, employees, or representatives of Norden Floors merely because a customer learned about them through a referral, recommendation, directory, or other source.
Norden Floors is not responsible for workmanship performed by an independent installer or contractor.
Installation-related problems may include, without limitation:

Improper subfloor preparation

Failure to perform appropriate moisture testing

Improper adhesive selection or application
-
Incorrect fasteners
-
Inadequate expansion space
-
Incorrect installation method
-
Improper acclimation
-
Installation over unsuitable surfaces

Improper radiant-heat conditions
-
Inadequate environmental control
-
Failure to follow applicable installation instructions
If a possible manufacturing or product issue is discovered during installation, installation of the affected material should stop and Norden Floors should be contacted before proceeding.
Jobsite and Environmental Conditions
Wood flooring naturally responds to environmental conditions.
Changes in temperature and humidity may result in normal expansion, contraction, seasonal movement, minor gaps, or other dimensional changes.
Customers are responsible for maintaining the installed environment within the ranges specified in applicable installation, care, maintenance, and warranty documentation.
Damage resulting from abnormal moisture, flooding, leaks, standing water, excessive dryness, excessive humidity, construction moisture, insufficient HVAC operation, improper cleaning, inadequate site preparation, or other unsuitable environmental conditions may not be covered by an applicable warranty.
Additional Material and Future Repairs
Because wood flooring may vary between manufacturing runs and products may be modified or discontinued over time, Norden Floors does not guarantee that matching material will remain available indefinitely.
Customers should consider retaining an appropriate quantity of unused material from the original installation for possible future repairs.
Future production runs may differ in color, texture, grain, shade, dimensions, finish, or appearance from previously purchased material.
Returns and Refunds
Returns, cancellations, exchanges, damaged products, defective-product claims, restocking fees, return-shipping responsibilities, non-returnable products, custom orders, and refunds are governed by the Norden Floors Refund, Return & Damage Policy.
That policy is incorporated into these Terms by reference.
Where there is a conflict concerning a return, cancellation, refund, exchange, or damage claim, the more specific applicable provision of the Refund, Return & Damage Policy will control unless prohibited by applicable law.
Product Warranties
Certain Norden Floors products may be covered by written warranties.
Applicable warranty terms may vary by product and may include structural, residential finish, light commercial, commercial, or other warranty coverage.
Warranty claims are subject to the terms of the applicable written warranty, including eligibility requirements, exclusions, limitations, conditions, claim procedures, and available remedies.
Customers are responsible for reviewing the applicable product warranty and installation requirements before installation.
No website statement, marketing material, sample, photograph, verbal statement, salesperson statement, estimate, or other communication modifies an applicable written warranty unless the modification is expressly made in writing by an authorized representative of Norden Floors.
Nothing in these Terms excludes or limits warranties or consumer rights that cannot legally be excluded or limited.
Warranty and Claim Remedies
Where permitted by applicable law and subject to the applicable written warranty, Norden Floors' obligations relating to a valid product claim may be limited to the remedies described in the applicable warranty, which may include repair, replacement, refund, or another specified remedy.
Unless expressly provided by an applicable written warranty or required by law, Norden Floors is not responsible for costs or losses involving:

Trade, Contractor, Designer, and Commercial Purchases
Norden Floors may offer trade, contractor, designer, hospitality, builder, developer, or other professional purchasing programs.
Eligibility, pricing, discounts, minimum order requirements, payment terms, shipping terms, and program benefits may vary.
Trade or commercial pricing is not transferable and may not be combined with other promotions, coupons, or discounts unless expressly authorized.
Participation in a trade or professional program does not create an agency, partnership, franchise, employment, fiduciary, or joint-venture relationship between Norden Floors and the participant.

Resale
Unless authorized by Norden Floors, products purchased through our consumer website are intended for the customer's own project or permitted use and not for unauthorized commercial resale.
We reserve the right to restrict quantities, refuse orders, or cancel transactions that reasonably appear to involve unauthorized resale, fraud, distribution, or other activity inconsistent with our sales policies, subject to applicable law.
Optional Tools and Third-Party Services
We may provide access to third-party tools, services, applications, payment processors, financing providers, shipping services, or integrations that we do not own or control.
Such third-party services may be provided on an “as is” and “as available” basis and may be subject to the third party's own terms, conditions, and privacy policies.
Your use of third-party services is at your discretion and subject to the applicable provider's terms.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NORDEN FLOORS AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SERVICE, A PRODUCT, AN ORDER, DELIVERY, INSTALLATION, OR THESE TERMS, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF USE, BUSINESS INTERRUPTION, PROJECT DELAYS, OR SIMILAR LOSSES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NORDEN FLOORS' AGGREGATE LIABILITY ARISING FROM A PRODUCT CLAIM WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO NORDEN FLOORS FOR THE PRODUCT GIVING RISE TO THE CLAIM, EXCEPT WHERE A DIFFERENT REMEDY IS REQUIRED BY APPLICABLE LAW OR EXPRESSLY PROVIDED UNDER AN APPLICABLE WRITTEN WARRANTY.
THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.
Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Norden Floors and its affiliates, officers, directors, employees, agents, contractors, suppliers, and service providers from third-party claims, liabilities, losses, damages, and reasonable costs arising from:

In connection with a payment dispute or chargeback, Norden Floors may provide payment processors, banks, financial institutions, card networks, carriers, or other relevant parties with information reasonably necessary to investigate or respond to the dispute.

You may stop using the Service at any time.
We may suspend or terminate your access to all or part of the Service if we reasonably believe you have materially violated these Terms, engaged in fraud or unlawful activity, or misused the Service.
Obligations and liabilities incurred before termination survive termination where applicable.
Governing Law
These Terms and any dispute arising from or relating to the Service or products purchased from Norden Floors will be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles, except to the extent another law is required to apply.
Jurisdiction and Venue
To the extent permitted by applicable law, any legal proceeding arising from or relating to these Terms, the Service, or a purchase from Norden Floors that is not otherwise subject to a valid alternative dispute-resolution agreement will be brought exclusively in the appropriate state or federal courts located in Travis County, Texas.
Each party consents to the jurisdiction and venue of those courts to the extent legally permitted.
Nothing in this section limits any rights or remedies that cannot legally be waived under applicable law.
Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.

Assignment

Norden Floors may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, corporate reorganization, sale of assets, or similar transaction, subject to applicable law.
Entire Agreement
These Terms, together with the policies, warranties, and documents expressly incorporated by reference, constitute the agreement between you and Norden Floors regarding your use of the Service and applicable purchases.
